Board of Adjustment
The Midvale City Board of Adjustment is made up of five members and two alternates. These members are appointed by the Mayor with the advice and consent of the City Council. Members are required to reside within Midvale City.
The Board of Adjustment is a quasi-judicial body. Its duties include hearing appeals of decisions on certain land use applications and authorizing variances to specific terms of the Zoning Ordinance. The Board is limited by State Law and may only grant a variance if all of the following standards are met:
- Literal enforcement of the zoning ordinance would cause an unreasonable hardship for the applicant that is not necessary to carry out the general purpose of the zoning ordinance. A hardship may not be economical, aesthetic, or self-imposed.
- There are special circumstances attached to the property that do not generally apply to other properties in the same district.
- Granting the variance is essential to the enjoyment of a substantial property right possessed by other property in the same district.
- The variance will not substantially affect the general plan and will not be contrary to the public interest.
- The spirit of the zoning ordinance is observed and substantial justice done.
Meetings
The Board of Adjustment holds meetings on the third Thursday of each month, as needed. Meetings begin at 6:30 pm in the Council Chambers at City Hall (655 West Center Street – west entrance). These meetings are open to the public.
